Every FINTRAC-registered MSB must appoint a Compliance Officer responsible for its AML/CTF compliance programme. For operators without staff in Canada, a fractional Compliance Officer from MAXCORP's Toronto team covers the role and the substance banks look for.

Canada does not require local staff to register an MSB, but banks apply their own substance expectations. A Canadian-resident Compliance Officer, a Toronto address and FINTRAC liaison give your MSB a credible local profile, from the day a ready-made MSB is transferred. What a Compliance Officer does for a Canadian MSB

Under the PCMLTFA and its regulations, the Compliance Officer is responsible for the MSB's compliance programme. The role starts before the first client is onboarded and continues as ongoing oversight.

Standard includes up to 20 hours of Compliance Officer services a month. Ad-hoc advisory and extra legal hours: €450 per hour. Minimum term 3 months, then monthly with 30 days' notice. Terms may be adjusted for high business or transaction volumes. Setup fees are waived for clients who acquired their MSB through MAXCORP; for others a one-time onboarding fee may apply, quoted on request.

Options

Canadian-resident or non-resident Compliance Officer

FINTRAC does not set a residency requirement for the Compliance Officer, so you can choose. We provide both, depending on your time zone, team structure and banking needs.

Canadian-resident CO

Meets FINTRAC requirements and the due diligence of Canadian banks, most of which expect a Canadian-resident CO when onboarding an MSB. The stronger choice when banking access is a priority from day one.

Can be combined with a registered address at our Toronto office for a full local presence.

Non-resident CO

Allowed, as FINTRAC sets no residency requirement, and practical for operators in European or Asian time zones who want oversight aligned with their working hours.

Requires deep knowledge of Canadian AML/CTF law and is best paired with non-Canadian banking partners, as Canadian banks rarely onboard MSBs without a Canadian‑resident CO.

Canada MSB compliance: frequently asked questions

Is a Compliance Officer mandatory for an MSB?

Yes. Every FINTRAC-registered MSB must appoint a Compliance Officer responsible for its AML/CTF compliance programme. Operating without one can lead to administrative monetary penalties.

Does the CO need to live in Canada?

FINTRAC does not require Canadian residency. Most major Canadian banks, however, expect a Canadian-resident Compliance Officer when they onboard an MSB. We provide both options.

What is a fractional Compliance Officer?

An experienced AML professional retained monthly who fulfils the full Compliance Officer role. The regulatory responsibilities are the same as for a full-time hire; only the engagement differs: a retainer instead of employment, an immediate start instead of recruitment, and a scope that grows with your volumes.

How quickly can the service start?

For a new MSB, the service starts before your registration is filed, since the Compliance Officer is named in the application. For a ready-made MSB, it starts on the day of the transfer, so there is no compliance gap. A service agreement defining the scope, reporting and fees is signed before the start.

Can you provide a Canadian business address?

Yes. MAXCORP's Canadian physical presence at our Toronto law firm address is part of every package. It meets FINTRAC registration needs and the address expectations of banks without leasing your own premises.

Do you support foreign MSBs and RPAA providers?

Yes. We work with Canadian MSBs and foreign MSBs registered with FINTRAC. For MSBs also registered under the RPAA with the Bank of Canada, the Compliance Officer's scope can include RPAA obligations, safeguarding oversight and Bank of Canada reporting.

What is the minimum term?

Three months on all packages. After that the service continues monthly until cancelled with 30 days' notice.

Are there setup fees?

Setup fees are waived for clients who acquired their Canadian MSB through MAXCORP. For other clients a one-time onboarding fee may apply, quoted on request.
